Welcome to GoMingle! This agreement applies as between you, the User of this Website and GoMingle, and the owner(s) of this Website. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. Please read them carefully before using GoMingle. If you do not agree with these terms, please do not use our services.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
"Content" means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
"Learning Establishment" means any provider of education to persons of any age including, but not limited to, schools, colleges, universities and professional / adult education providers;
"GoMingle" means GoMingle of Gauteng, South Africa;
"Service" means collectively any online facilities, tools, services or information that GoMingle makes available through the Website either now or in the future;
"System" means any online communications infrastructure that GoMingle makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
"User" / "Users" means any third party that accesses the Website and is not employed by GoMingle and acting in the course of their employment; and
"Website" means the website that you are currently using and any sub-domains of this site unless expressly excluded by their own terms and conditions.
2. Overview of GoMingle
GoMingle is an event-based media collection platform that allows Event Hosts to create personalised Event Pages and collect photos, videos and other content from guests through a unique QR code or event link. These Terms of Use govern your access to and use of GoMingle, including any content, functionality and services offered through the GoMingle website and platform.
3. User Eligibility
GoMingle is available only to individuals aged 18 and above. By using GoMingle, you confirm that you are at least 18 years old and capable of entering into legally binding agreements.
4. Account Registration & Security
4.1 Certain features may require you to create an account using your email address or a supported third party authentication service.
4.2 You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
4.3 You agree to notify GoMingle promptly if you suspect that your account has been accessed without authorisation.
5. User Responsibilities
5.1 When using GoMingle, you agree NOT to:
5.1.a Upload illegal, offensive, abusive or inappropriate content, including hate speech, pornography, violence or copyrighted material without permission;
5.1.b Share or distribute content that violates the privacy, intellectual property or other rights of another person;
5.1.c Attempt to hack, disrupt or interfere with GoMingle or its services;
5.1.d Attempt to gain unauthorised access to an Event, account or other part of the platform; and
5.1.e Use GoMingle for unlawful or fraudulent purposes.
5.2 GoMingle reserves the right to remove content, restrict access to Events or suspend accounts that violate these Terms of Use.
6. Media Uploads & Storage
6.1 Guests can upload photos and videos to an Event using its unique QR code or event link. Uploaded media is stored for 45 days from the date it was uploaded, unless otherwise stated by the applicable plan or service. Once the applicable retention period has expired, media may be permanently deleted and cannot be recovered.
6.2 Event Hosts are responsible for downloading or otherwise preserving media they wish to keep before it expires. GoMingle is not responsible for lost or expired media after the applicable retention period.
Important: The expiration of an Event Page and the expiration of individual uploaded media may occur at different times. Please refer to the applicable plan information for details.
7. Payments & Subscription Plans
7.1 GoMingle offers free and paid subscription plans.
7.1.a Free Plans: May provide access to a limited selection of features and usage.
7.1.b Paid Plans: May provide additional features, storage, Event functionality or usage limits.
7.2 Pricing, features and limitations may vary between plans and may be updated from time to time.
7.3 Payments are non-refundable, unless otherwise stated or required by applicable law.
7.4 Where subscriptions automatically renew, they will continue to renew unless cancelled before the applicable renewal date.

8. Intellectual Property
8.1 Subject to the exceptions in Clause 8 of these Terms and Conditions, all Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of GoMingle, or our affiliates.
8.2 Users retain ownership of the photos, videos, and other content they upload.
8.3 By uploading content to GoMingle, you grant GoMingle a non-exclusive licence to store, process and display that content as necessary to provide and operate the Service. This license does not transfer ownership of your content to GoMingle.
8.4 You may print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Website for as specified in Clause 9 of these Terms and Conditions and for personal or educational purposes only unless otherwise indicated on the Website or unless given express written permission to do so by GoMingle. Specifically you agree that:
8.4.a You will not use the Content of the Website for commercial purposes;
8.4.b You will not systematically copy Content from the Website with a view to creating or compiling any form of comprehensive collection, compilation, directory or database unless given express written permission to do so by GoMingle;
8.4.c You may, as a student of a recognised Learning Establishment, use the Content of the Website for educational purposes provided an appropriate reference is given for all Content so applied using a suitable referencing system of your choice or as stipulated by your Learning Establishment; and
8.4.d Employees of Learning Establishments may use the Content of the Website for teaching purposes subject to the following conditions:
a) No further consent is required for use in not-for-profit Learning Establishments. This may include, but is not limited to, schools that charge no fees for tuition; and
b) For use in profit-making Learning Establishments, prior written consent is required. This may include, but is not limited to, private schools charging fees, universities and adult education providers.
9. Third Party Intellectual Property
Where expressly indicated, certain Content and the Intellectual Property Rights subsisting therein belongs to other parties. This Content, unless expressly stated to be so, is not covered by any permission granted by Clause 7 of these Terms and Conditions to use Content from the Website. The exceptions in Clause 9 continue to apply. Any such Content will be accompanied by a notice providing the contact details of the owner and any separate use policy that may be relevant.
10. Fair Use of Intellectual Property
Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
11. Third Party Services
11.1 GoMingle may offer integrations with third-party services, such as cloud storage providers. Third party services operate independently and may have their own terms, conditions and privacy policies.
11.2 GoMingle is not responsible for the availability, functionality or policies of third party services. Nothing in these Terms and Conditions shall confer any rights upon any third party.
11.3 The agreement created by these Terms and Conditions is between you and GoMingle.
12. Links to Other Websites
12.1 This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of GoMingle or that of our affiliates.
12.2 We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.
12.3 The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them
13. Links to this Website
13.1 Those wishing to place a link to this Website on other sites may do so only to the home page of the site www.GoMingle.co.za URL of homepage without prior permission.

14. Use of Communications Facilities
14.1 When using the Forums / Chat or similar and / or any other System on the Website you should do so in accordance with the following rules:
14.1.a You must not use obscene or vulgar language;
14.1.b You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
14.1.c No Content that is intended to promote or incite violence;
14.1.d It is advised that posts on Forums / Chat or similar and communications with GoMingle are made using the English language(s) as we may be unable to respond to enquiries submitted in any other languages;
14.1.e You must not post links to other websites containing any of the above types of Content;
14.1.f The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws;
14.1.g You must not engage in any form of commercial advertising. This does not prohibit references to businesses for non-promotional purposes including references where advertising may be incidental;
14.1.h You must not impersonate other people, particularly employees and representatives of GoMingle or our affiliates; and
14.1.i You must not use our System for unauthorised mass-communication such as "spam" or "junk mail".
14.2 You acknowledge that GoMingle reserves the right to monitor any and all communications made to us or using our System.
14.3 You acknowledge that GoMingle may retain copies of any and all communications made to us or using our System.
14.4 You acknowledge that any information you send to us through our System or post on the Forums / Chat or similar may be modified by us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon our use of such information must be communicated to us in advance and we reserve the right to reject such terms and associated information.
14.5 In order to use the Forums / Chat or similar and any other communication facility that may be added in the future on this Website, you are required to submit certain personal details. By continuing to use this Website you represent and warrant that:
14.5.a Any information you submit is accurate and truthful; and
14.5.b You will keep this information accurate and up-to-date.
15. Termination of Services
15.1 GoMingle reserves the right to suspend or terminate an account or Event where:
15.1.a You violate these Terms of Use;
15.1.b Your content repeatedly violates our policies;
15.1.c There is fraudulent, suspicious or unauthorised activity; and
15.1.d Your use of the platform creates a security, legal or operational risk.
15.2 Users may request deletion of their account by contacting [email protected].
16. Limitation of Liability
16.1 GoMingle and services is provided on an “as-is” and “as-available” basis. Users should be aware that they use the Website, its Content, and GoMingle services at their own risk.
16.2 We do not guarantee and give no warranty that the platform will always be free from errors, bugs, interruptions or security issues. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
16.3 We are not responsible for any direct or indirect loss of data, media, special or exemplary damages resulting from, but not limited to, technical failures, service interruptions, power failure, natural events, acts of war, ISP equipment failure, host equipment failure, third party services, or failure to download media before its expiration.
16.4 Users are responsible for the content they upload and their use of the GoMingle platform.
16.5 GoMingle reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, the products and / or services available.
16.6 Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited.
17. Privacy & Data Protection
17.1 Your privacy is important to us. Our Privacy Policy explains how we collect, use, store and protect your information, and is incorporated into these Terms and Conditions by this reference.
17.2 GoMingle does not sell user data for marketing purposes.
17.3 Users may request account deletion and removal of personal information, subject to applicable legal and operational requirements.

18. Changes to These Terms
18.1 GoMingle may update these Terms of Use from time to time. Where significant changes are made, we may notify users through the platform, website or other appropriate means.
18.2 Continued use of GoMingle after updated Terms take effect means that you accept the revised Terms.
18.3 In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
19. Disclaimers
19.1 GoMingle makes no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, or that it will be secure.
19.2 Whilst every reasonable endeavour has been made to ensure that all information provided on this Website will be accurate and up to date, GoMingle makes no warranty or representation that this is the case. We make no guarantee of any specific results from the use of our services.
19.3 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
19.4 The information on this Website is not designed with commercial purposes in mind. Commercial use of the Content of this Website is forbidden under sub-Clause 8.4.1 of these Terms and Conditions. Any such use constitutes a breach of these Terms and Conditions and GoMingle makes no representation or warranty that this Content is suitable for use in commercial situations or that it constitutes accurate data and / or advice on which business decisions can be based.
19.5 Whilst every effort has been made to ensure that all descriptions of services available from GoMingle correspond to the actual services available, GoMingle is not responsible for any variations from these descriptions.
19.6 Whilst GoMingle uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers..
20. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
21. Communications
21.1 All notices / communications shall be sent to us by email to [email protected]. Such notice will be deemed received the day of sending if the email is received in full on a business day or on the next business day if the email is sent on a weekend or public holiday.
21.2 GoMingle may from time to time send you information about our products and / or services. If you do not wish to receive such information, please unsubscribe, e.g. "click on the 'Unsubscribe' link in any email which you receive from us."
